Contest Rules

1. NO PURCHASE NECESSARY TO ENTER OR CLAIM A PRIZE. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. QUALIFIED ENTRANTS MAY ENTER AS OFTEN AS THEY WISH. VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW.

2. CONTEST PERIOD:The Contest will begin on Thursday October 15, 2009 and will end on Monday November 30, 2009.

3. JUDGES:The contest will be judged by visitors to MattressOfYourDreams.com and Bragada officials. Bragada officials choice of winners will be final as to all matters. Bragada will use visitors votes as a guide to choosing the winner.

4. ODDS: Odds of winning any prize depend upon the number of eligible entries.

5. PRIZE LIMITATION:Only one (1) winner per household. Individuals are eligible to win only one (1) prize from Bragada within any 30-day period, regardless of the number of giveaways entered. Winner(s) of the Competition must claim the prize within 7 days of the winner(s) being posted or the prize will be forfeited.

6. PUBLICITY RELEASE: Except where prohibited by law, each entrant gives permission to the Sponsor and acknowledges that entry in the Contest constitutes each entrant's consent to use, publish, reproduce and for all purposes, including publicity, promotion and advertising, in any media (including without limitation, the Internet, television or offline promotions), each winner's name, likeness, and any portion thereof, each extending throughout the universe and in perpetuity without further compensation, credit or right of review or approval. Without limiting the generality of the preceding sentence, the Sponsor shall own all rights, title and interest in and to all photo's, testimonials, and written comments made in connection with the Competition.

7. TAXES: Any valuation of the prize(s) stated is based on available information provided to Bragada, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. All taxes, including federal, state and local taxes, are the sole responsibility of winner. Any person winning over $600 in prizes from Bragada will receive a 1099 form at the end of the calendar year and a copy of such form should be filed with the IRS. Each winner must provide Bragada with valid identification before any prize will be awarded.

7.1 Shipping: All winners are responsible for the shipping and handling of the prize(s) they have won.

8. LIST OF WINNERS: Within 10 days at the end of the contest, a list of winners will be available to view on MattressOfYourDreams.com.

9. LIMITATION OF LIABILITY & OTHER CONDITIONS: The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Contest or any portion hereof, or to disqualify any individual implicated in any of the following actions, if for any reason: (a) infection by computer virus, bugs, interruption in wireless calling devices or wireless service, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes which, in the Sponsor's sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, (b) the Contest or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these Official Rules, (c) the Contest is otherwise not capable of running as planned. By entering, entrants represent that they are eligible and agree to be bound by and comply with the Official Rules and the decisions of the judges. Entrants further agree to re lease, hold harmless and indemnify the Sponsor and each of their parent, subsidiary companies, affiliates, divisions, franchisees, representatives, consultants, subcontractors, suppliers, distributors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, and their officers, directors, employees, shareholders and agents (collectively the "Released Parties"), from and against any and all claims, actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with participation in and/or entry into the Contest or acceptance, delivery or use of any prize. The Released Parties are not responsible or liable for any incorrect or inaccurate entry information or other errors in the printing, offering or administration of the giveaway or in the announcement of the prize(s) and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, interrupted or unav ailable network, server or other conditions, (ii) failure of any entry to be received by the Sponsor due to technical problems, human error, (iii) communication line, hardware and/or software failures, (iv) damage to any computer (software or hardware) resulting from participation in the Contest, or damage to mobile phone or other PDA device, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, or (vi) entries which are late, lost, stolen, damaged, illegible, and/or unintelligible (or any combination thereof). Any entrant who attempts to tamper with this Contest in any way shall be disqualified. Bragada reserves the right to disqualify any entrant at any time, for any reason, including, without limitation, language, lyrics, activities or behavior deemed inappropriate. By participating, entrants agree that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to any prize. The Sponsor and their advertising and promotion agencies are not responsible for cancellations, postponements, or delays. Bragada shall have the sole discretion to administer the Competition and interpret and apply the Official Rules. Any expenses incurred by the entrant during the application process, including but not limited to, postage, S/H of prize are the sole responsibility of each applicant and the Sponsor will not issue reimbursement for any expenses.

10. ARBITRATION/CHOICE OF LAW: Except where prohibited, entrants agree that any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved exclusively by arbitration pursuant of the Rules of the American Arbitration Association then effective. The Sponsor shall not be responsible for any attorneys' fees, punitive, incidental, consequential or other damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of New York or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than New York. The invalidity or unenforceability of any provision of these Official Rules remains in ef fect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
